Brisk Catering Terms and Conditions

  1. Introduction Welcome to Brisk Catering! These Terms and Conditions (“Terms”) apply to all services provided by Brisk Catering (“we,” “us,” or “our”) to our clients (“you,” “your,” or “client”). By booking our services, you agree to these Terms. Please read them carefully.
  2. Services Provided Brisk Catering offers catering services for corporate and private events in Melbourne, Victoria, Australia. Our services include, but are not limited to, the preparation, delivery, and setup of food and beverages.
  3. Quotations and Bookings Quotations: All quotations provided are valid for 30 days from the date of issue unless otherwise specified. Prices are based on the details provided by the client, and any changes to the event requirements may result in an adjustment of the quoted price. Bookings: A booking is confirmed once an order confirmation is sent or a deposit (as outlined in section 4) has been received. We reserve the right to decline or cancel bookings at our discretion.
  4. Payment Terms Deposit: A non-refundable deposit of 50% of the total quoted amount is required to secure your booking where your invoice is greater than $4,000. The deposit must be paid within 7 days of receiving the invoice. Final Payment: The remaining balance is due 7 days after the event date. Payment Methods: We accept payment via bank transfer, credit card, and other methods as agreed upon. Late Payment: Late payments may incur a fee of 2% of the outstanding balance per week. Collections: The customer is liable to pay all legal costs (including all solicitors fees and overdue interest charges) as well as the costs of any mercantile agents. Should your account be defaulted upon and outsourcing to a third-party collection agency is required; any fees associated with the collection of the outstanding account shall be added to the debt. This may include and is not limited to the following: commission costs, interest, recoverable legal costs and administration fees. Should your account be referred to a collection agency a “collection notice/default” may be listed upon your ABN’s credit file.
  5. Cancellations and Amendments General Cancellations: Cancellation charges apply once your catering requirements have been confirmed verbally or in writing and where costs have been incurred for food, labor, or other services. Cancellation Deadlines:
  • Up to 20 people: By 2:00 PM the business day before the event.
  • 20 to 50 people: 2 business days prior to the event.
  • 50 or more people: 5 business days prior to the event. Staff Cancellations: Full staff charges may apply if staff are canceled within 1 business day prior to the event. Amendments: Any changes to the booking must be communicated in writing at least 48 hours before the event. While we will endeavor to accommodate changes, they may be subject to additional charges. Exceptional Circumstances: We understand that cancellations may occur due to unforeseen circumstances. We will work with you to minimize the cost of cancellations.
  1. Refunds Administration Fee: In the event that a refund is issued, Brisk Catering reserves the right to charge a 2% administration fee to cover merchant fees and administrative time. This fee will be deducted from the total amount refunded.
  2. Event Changes and Delays Event Changes: Any changes to the event date, location, or requirements must be communicated as soon as possible. We cannot guarantee our availability for rescheduled events and may treat rescheduling as a cancellation. Delays: If the event start time is delayed by more than 30 minutes due to the client or their guests, additional charges may apply.
  3. Menu Selection and Dietary Requirements Menu Selection: Final menu selections must be provided at least 24 hours before the event. Failure to do so may result in limited menu options. Dietary Requirements: We cater to various dietary needs; however, it is the client’s responsibility to provide accurate dietary information for their guests. We will not be held responsible for any adverse reactions if incorrect or incomplete information is provided.
  4. Service and Equipment Staffing: Our service includes professionally trained staff for food and beverage service. The number of staff required will be determined based on the event size and service style. Equipment Hire: If additional equipment (e.g., tables, chairs, crockery) is required, it will be quoted separately. The client is responsible for any loss or damage to hired equipment.
  5. Food Safety and Liability Food Safety: We follow strict food safety guidelines. However, once food is delivered or set up, we cannot be held responsible for its handling or storage by the client or their guests. Liability: Brisk Catering will not be liable for any indirect, special, or consequential losses. Our total liability under these Terms will not exceed the total amount paid for the services.
  6. Event Insurance We recommend that clients obtain event insurance to cover unforeseen circumstances, including cancellations, damages, or injuries during the event.
  7. Force Majeure Brisk Catering is not liable for any failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, lockouts, or other events considered to be acts of God.
  8. Governing Law These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Victoria.
  9. Privacy We respect your privacy and will only collect, store, and use your personal information in accordance with applicable privacy laws. We will not share your information with third parties without your consent, except where necessary to provide our services.
  10. Amendments to Terms Brisk Catering reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to clients with active bookings.
  11. Acceptance of Terms By confirming a booking with Brisk Catering, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
  12. Free CBD Delivery Eligibility: We offer free delivery to the CBD, Docklands, and St Kilda Road precincts for catering orders over $80. For orders below $80, a $10.00 delivery fee may apply. Delivery Areas: Deliveries outside the specified free delivery zones are available upon request, and delivery fees will apply.
  13. Delivery Times Weekdays: Brisk Catering delivers between 7:00 AM and 5:30 PM on weekdays. After-Hours Deliveries: Deliveries or pickups required outside these hours will incur additional charges. Cold Food Orders: Cold food orders may be delivered up to 90 minutes prior to your confirmed delivery time. Hot Food Order: Hot food orders may be delivered up to 15 minutes prior to your confirmed delivery time.
  14. Weekend Orders Availability: Weekend orders are available upon request and are subject to a 15% surcharge and minimum spend requirements.
  15. Terms of Trade Corporate Catering: Payment is due 7 days from the date which the service was provided. Private Catering: Full prepayment of the entire order value is required to confirm your booking.
  16. GST Inclusive Pricing: All quoted prices include applicable GST charges. Any statutory changes to GST will be passed on to customers.
  17. On-Time Delivery Guarantee Guarantee: If we are late delivering your catering, please notify us within one hour of the due time, and we will credit your order. Conditions:
  • Applies to orders placed by 5:00 PM the day prior.
  • Applies to catering orders under $1,000.
  • Does not apply to delays caused by building access issues or major traffic disruptions, such as street marches or delays due to the Melbourne Metro Rail Project. In such cases, we will keep you informed.
  1. Third-Party Delivery Services Usage: While we prefer to use our internal logistics team, there may be instances where third-party couriers are utilized. If this occurs, we will notify you, and we kindly ask that you meet the driver in front of your location for ease of delivery.
  2. Pricing Fluctuations Price Adjustments: All prices are correct at the time of printing and are based on current costs. Prices may vary due to seasonal or supplier changes. Please refer to www.briskcatering.com.au for the most up-to-date pricing. Right to Alter: Brisk Catering reserves the right to alter or adapt menus, prices, and services as needed.
  3. Payment Methods Accepted Payments: We accept the following payment options:
  • Company cheque
  • VISA, MasterCard, and AMEX (a modest cost recovery surcharge applies)
  • EFT (Electronic Funds Transfer)
  1. Same-Day Last-Minute Orders Availability: We aim to accommodate last-minute orders. When you call, we may place you on hold while we confirm product and delivery availability with our kitchen. Fee: A $10.00 fee may apply to same-day orders to cover individualized food preparation and alterations to our delivery schedule.
  2. Lost or Broken Equipment Replacement Costs: Any lost or broken equipment will be charged at replacement cost.
  3. Deposit Requirements Large Functions: All functions booked with a value over $4,000 require a 50% deposit for confirmation. This deposit is non-refundable if the function is canceled within 7 working days of the function date.
  4. Platters Property: Platters remain the property of Brisk Catering. All platters are embossed with our logo and contact details for collection purposes. Collection: We will endeavor to collect platters as soon as possible after your event. Unrecoverable platters may incur a replacement charge.
